ANPCI restores the powers

The Moldovan National Association for the Protection of Intellectual Property, ANPCI has restored its accreditation in the field of collective management in December last year after long-lasting legal disputes.

 ANPCI was created in 2011 after the adoption of a new Law “On copyright and related rights”, which brought Moldavian legislation closer to EU regulation and international conventions in the field of protection of copyright and related rights.

However, as a result of disagreements with the State Agency for Intellectual Property of Moldova, the activity of ANPCI was suspended in 2013: the Agency refused to recognize the authority of ANPCI and cancelled the state accreditation.

Nevertheless, in December 2019, the Moldovan society achieved a fair decision of the court: the Аppeals Chamber of Chisinau recognized the Agency’s decisions as illegal and restored the powers of the ANPCI.

This decision will certainly give an impact to the active development of both the institution of collective management and the creative industries of the Republic of Moldova as a whole.

 

About ANPCI:

National Association for the Рrotection of Intellectual Property, ANPCI was registered by the Ministry of Justice of the Republic of Moldova on April 29, 2011. The goal of ANPCI is to improve the position of rightholders, increase authors’ remuneration and fight piracy.

The activities of ANPCI are based on the Law No. 139 “On Copyright And Related Rights”, adopted on July 2, 2010 by the Parliament of the Republic of Moldova. This law was adopted within the framework of the agreement between the European Union and the Republic of Moldova. The new law brought the legislation of the Republic of Moldova as close as possible to European legislation and international agreements in the field of copyright and related rights.

As of January 01, 2019, 195 rightolders of the Republic of Moldova are members of ANPCI, 30 international agreements were signed with foreign CMOs.

ANPCI represents all categories of copyright holders – authors, performers and producers of phonograms on the territory of the Republic of Moldova.
