CRSEA took part in the meeting organized by the Ministry of Justice of the Republic of Kazakhstan

Confederation of Rightholders’ Societies of Europe and Asia (CRSEA) at the invitation of the Ministry of Justice of the Republic of Kazakhstan took part in the meeting of the Committee of systematization and modernization of legislation of the Republic of Kazakhstan. The key question of the meeting – it was organized online – was a repeal of repayment for the authors and rightholders paid by creators and importers of outfit for the reproduction audiovisual works and audio recordings in their own aims.

According to the current legislation of the Republic of Kazakhstan there are minimum rates of remuneration for the reproduction audiovisual works and audio recordings in their own aims without the consent of the author (Decree of the Government of the Republic of Kazakhstan № 445, June 26, 2019) and accepted Direction of minimum rates of remuneration for the singers and creators of audiovisual works (according the Order from the Minister for justice of the Republic of Kazakhstan № 461, September 10, 2019).

CRSEA representative participated at the meeting as international expert in the sphere of intellectual property said that discussed topic played a great role in IP sphere. Topic deals with repeal of repayment is very special in the situation concerned at the extensive use of digital devices for making copies of mediacontent and worldwide use of different mobile devices with huge memory size. CRSEA thinks that in the situation when repayment will be repeal practically the whole work of specialists in IP sphere may be place under a threat, they suffer losses as a result of numerous.

Remuneration system is very popular in many countries. For example, in the Russian Federation this function realizes CRSEA member – Russian Union of Rightholders – which main goal is to realize fee collection for the import to the territory of the Russian Federation different types of devices and data storage media that allow playing, recording and holding audio- and video products. Russian Union of Rightholders divides remuneration amounts between authors, singers and rightholders of sound records and audiovisual works on the base of statistical data that include information about CD selling, the amount of playback on radio and TV, download statistics in the Internet.

In 2020 Eurasian union of righthoders has become a member of CRSEA. Eurasian union of righthoders is a Kazakhstan organization in the sphere of collective rights direction that was accredited by the Ministry of Justice of the Republic of Kazakhstan in the sphere of management of rights of authors, singers and creators of sound records and audiovisual works in order to collect remuneration for the reproduction audiovisual works and audio recordings in their own aims. According to the General Agreement Eurasian union of righthoders received authority to collect remuneration for private copying from Kazakh organizations-rightholders.

Effective work in the sphere of collecting remuneration for private copying may be the basis of income for the creators of intellectual activity results and also provide extra proceeds in the form of tax payments to the country budget.

CRSEA strongly supports necessity of compensation payment for the authors and rightholders and also sympathize with the Eurasian union of righthoders expecting that its work will be serve the cause of the Republic of Kazakhstan prosperity.
