Ministry of Culture of the Russian Federation will study the idea of the Russian Union of Industrialists and Entrepreneurs about remuneration payment for the usage of orphan works

Committee on intellectual property and creative industries of the Russian Union of Industrialists and Entrepreneurs (RSPP) sent official letter for the Ministry of Culture of the Russian Federation Olga Lyubimova about an idea connected with development of the institution of “equitable remuneration”. The author of the letter offered to add this concept to the Civil Code of the Russian Federation. The next step will be a remuneration payment for the authors of orphan works realized via designated institutions.

Nowadays legislation doesn`t include the standard regulated the right for equitable remuneration for the use of orphan works. RSPP representatives think that this situation is not correct. On the opinion of the author of the official letter, organization authorized by government can resolve this problem collecting payment from people who use results of intellectual activity and then divide money between authors when they will be found. Russian Union of Industrialists and Entrepreneurs thinks that it will be better to organize data processing, report of intellectual activity results and user identification on digital platforms.

Earlier reported that members of the Committee on intellectual property and creative industries of the Russian Union of Industrialists and Entrepreneurs suggested an idea to create special count for collection remuneration payment in order to give this money the author when he/she would be found.

«I doubt whether the sum of equitable remuneration will be more than 1 milliard rubles in total in a year. It`s not a huge sum of money but the idea is worth-while because its realization can protect authors and give business a chance not to break the law if they cannot find author», added Chairman of the Committee on intellectual property and creative industries, General Secretary of the Confederation of Rightholders’ Societies of Europe and Asia (CRSEA) Andrey Krichevskiy.
