Ministry of Justice of the Republic of Kazakhstan confirmed accreditation for two CRSEA organizations-members

On November 25 the Ministry of Justice of the Republic of Kazakhstan held a meeting of the Commission on accreditation of organizations managed property rights on collective basis on the territory of the Republic of Kazakhstan.

Organizations managed property rights on collective basis that decided to participate in the accreditation process in advance lodged applications. For the first time applications was lodged via system of electronic licensing «Е-license». As a result, there were eight applications from organizations-candidates.

Commission included such members as representatives of the Ministry of Justice of the Republic of Kazakhstan, People’s artist of the Republic of Kazakhstan, member of Union of the Public Chamber of Mazhilis of the Republic of Kazakhstan Aiman Musakhodzhaeva, the Chairman of the Public Council under the Ministry of Justice of the Republic of Kazakhstan and republican non-governmental organization «Kazakhstan law society» Akylbay Bayseituly and publicman, President of the National Chamber in the sphere of education and government «Serpin» Murat Abenov. Within the context of discussion all mentioned Commission members studied conclusion of the general meeting about the conformity of documents that candidates submitted for the accreditation, analyzed how these organizations divided and paid consideration, closely read authors and rightholders responses.

As a result, on the base of the Commission conclusion and in accordance with the article 7 Ch,46-2 of the Law of the Republic of Kazakhstan «About copyright and the related rights», article 9 of the rules of delivery public services «Accreditation of organizations managing property rights on a collective basis» was decided to give accreditation for two organizations – republican non-governmental organization «Kazakhstan Authors’ Society» and non-profit organization for the protection of copyright and related rights «Amanat».

Six organizations – republican non-governmental organization «Kazakhstan society managed intellectual property rights», republican non-governmental organization «Authors society «Aburoy», association of legal entities «Kazakhstan agency of intellectual property», non-governmental organization «National authors society», republican non-governmental organization «Singers of Kazakhstan songs» and republican non-governmental organization «Union of the authors of the songs» weren’t accredited. The reason of the refusal became nonpresentation of all documents mentioned on the Rules for the accreditation and non-performance of obligations towards authors and rightholders.

Two accredited organizations are the members of the Confederation of Rightholders’ Societies of Europe and Asia (CRSEA). The fact of its accreditation again confirmed effective work of CRSEA that has high eligibility criteria. As a result, the situation when CRSEA members are generally recognized contributes to cement place of the Confederation as an organization that realizes its aims and tasks with the help of credible partners.

CRSEA holds the position of careful choice of its members and favors the same position of the Ministry of Justice of the Republic of Kazakhstan. The Ministry defending authors` interests clears the sphere of author law and related rights out of all organizations that don`t realize declared obligations connected with the defense of creative industry representatives.
